Article 128
Judgment
(1)
Where the application is allowed under Article 239, the Supreme Court shall order a retrial and the public prosecutor shall file the charge in the Court having jurisdiction.
#(2)
Either side may, under the provisions of Book V, appeal to the ordinary appellate Court against the judgment of the Court of retrial.
