Article 75
Discharge of Guarantors
at any time, they bring the released person to the Court which granted bail and request that they be discharged as guarantors;
#they apply to the Court, which caused the bond to be taken, to discharge the bail bond, the Court issues a warrant for the arrest of the person on whose behalf the bail bond was executed and the person is arrested and brought before the Court; or
#they are of the opinion that the accused may abscond, they inform the Court, the Court issues an arrest warrant and the accused is in fact arrested.
#The guarantee shall lapse upon the death of the guarantor, provided death occurs before an order has been issued for the payment of the amount of his bond or for the forfeiture of his deposit. Any monies or securities deposited with the Court shall be returned to the guarantor’s personal representative.
#If the Court discharges the guarantors pursuant to sub-Article (1), or the guarantor has died, the accused shall be given the opportunity to find other guarantors, pursuant to Article 113, and if he is unable or refuses to do so, the Court may order his arrest and detention.
