Article 243
Failure to Control a Dangerous Fire
A person who knows that a fire is endangering life or property of another and fails to take reasonable measures to put out or control the fire, when that person can do so without substantial risk to oneself, where:
#that person knows that he or she is under an official, contractual or other legal duty to prevent or combat the fire; or
#the fire was started by the accused or with the assent of the accused, or on property in the custody or control of the accused,
#is guilty of the offence of failure to control a dangerous fire, a Class 1 petty offence, punishable with a definite term of imprisonment of not less than 6 months and not more than 12 months, or a fine of 20,001 – 50,000 Nakfas, to be set in intervals of 2,500 Nakfas.
