Article 353
Fraud in Relation to Minerals or Mineral Rights
A person who, being the holder of a lease or license or permit issued under a law relating to the exploration or minerals:
#fraudulently conceals or makes a false statement with respect to the quantity or quality of metals owned or procured by him; or
#sells any rock, mineral, or other substance that contains any precious metals or hydrocarbons, or untreated, unsmelted, or partly treated or smelted precious metals or hydrocarbons by misrepresenting one's ownership, leasing or licensing or permitting status,
#is guilty of fraud in relation to minerals or mineral rights, a Class 8 serious offence, punishable with a definite term of imprisonment of not less than 3 years and not more than 5 years.
#For purposes of this Article “precious metals” and “hydrocarbons” shall have the same definition as contained in the laws under which the leases or licenses or permits have been granted.
