Article 360

A person who, for purposes of commercial advantage or private financial gain:

infringes, imitates or passes off, in such manner as to deceive the public, another’s mark or distinctive signs or declarations of origin on any product, goods or their packing, whether commercial, industrial or agricultural;

sells or offers for sale, imports or exports, distributes or places on the market products or goods under a mark which that person knew to be infringed, imitated, passed off or improperly affixed;

refuses to declare the origin of products or goods in one's possession under such marks; or

takes any of the actions specified in paragraphs (a), (b) or (c) with respect to industrial designs or models, patented inventions or processes, duly registered and protected by existing national or international agreements,

Offences under sub-Article 1 may only be prosecuted upon the preferring of charges by the victim.
