Article 360
Infringement of Marks, Declarations of Origin, Designs or Models
infringes, imitates or passes off, in such manner as to deceive the public, another’s mark or distinctive signs or declarations of origin on any product, goods or their packing, whether commercial, industrial or agricultural;
#sells or offers for sale, imports or exports, distributes or places on the market products or goods under a mark which that person knew to be infringed, imitated, passed off or improperly affixed;
#takes any of the actions specified in paragraphs (a), (b) or (c) with respect to industrial designs or models, patented inventions or processes, duly registered and protected by existing national or international agreements,
#is guilty of infringement of marks, a Class 9 serious offence, punishable with a definite term of imprisonment of not less than 1 year and not more than 3 years.
