Article 359
Fraudulent Unfair Competition
A person who intentionally competes with another by means of deception or another process contrary to rules of good faith in business including by:
#discrediting another, his goods or dealings, his activities or business, or by making untrue or false statements as to his own goods, dealings, activities or business in order to derive a benefit therefrom against his competitors;
#taking measures such as to create confusion with the goods, dealings or products or with the activities or business of another;
#using inaccurate or false styles, distinctive signs, marks or professional titles in order to induce a belief as to his particular status or capacity;
#granting or offering anything to employees, agents or representatives of another in order to induce them to fail in their duties or obligations in their work, or to induce them to discover or reveal any secret of manufacture, organization or process; or
#revealing or taking advantage of such secrets obtained or revealed in any other manner contrary to good faith,
#is guilty of fraudulent unfair competition, a Class 9 serious offence, punishable with a definite term of imprisonment of not less than 1 year and not more than 3 years.
#An offence under sub-Article (1) may only be prosecuted upon the preferring of charges by the victim.
