Article 1465
Passing of the Right to Choose
Where one of the parties is entitled to make the choice, the right to choose passes to the other party if it has given its counterpart a reasonable period of time in which to determine the choice and the latter has not chosen within this period.
#The right to choose, however, does not pass to the creditor until he becomes entitled to claim performance, nor to the debtor until he has the right to perform.
#Where a third party should make the choice, any interested party may request the Court to choose if it has given that third party a reasonable period of time in which to determine the choice and the latter has not chosen within this period, unless otherwise follows from the contract.
#Sub-Article (3) shall apply mutatis mutandis where two or more persons should make the choice together and they do not agree.
