Article 1561
Effect
(1)
Where the third party ratifies the promise concerning him, the person who stood promisor shall be released.
#(2)
Unless otherwise agreed, such person shall not guarantee the proper performance of the contract.
#(3)
Where the third party does not ratify the contract, the person who stood promisor for him shall be liable towards the other contracting party for the injury resulting from the non-performance of the contract.
