Article 1884
Definition. Limitation on Gifts Inter Vivos
A gift is a contract by which a person, the donor, transfers without compensation his property or assumes an obligation with the intention of gratifying another person, the donee.
#Notwithstanding the provisions of sub-Article (1), where the donor has descendants, he may, in case of gifts that take effect during the lifetime of the donor, not make a gift in excess of two-thirds of the total of his property.
#A gift exceeding two-thirds of the total property of the donor under the conditions prescribed in sub-Article (2) shall be reduced to that amount by the application of any one of his descendants.
#The application for reduction under sub-Article (3) shall be made within two years of the date the gift was made.
#An application for reduction made under sub-Article (3) shall be denied if the applicant was unworthy at the time the application was made under the provisions specified in the Book of this Code relating to Succession.
#For purposes of this Article, the value of the property shall be that which the property had at the time the gift was made.
