Article 2353
Failure to Provide Lodging
(1)
The hotelkeeper shall be liable for the damage actually suffered by the guest to the extent that he fails to provide the lodging and services agreed upon.
#(2)
He nevertheless shall be released from liability to the extent that, with the consent of the guest, he procures for him equivalent lodging and services at the same locality.
#(3)
If substitute lodging is accepted, the hotelkeeper shall reimburse the guest’s reasonable expenses, including the cost of transport, which the substitution entails.
