Article 389

The parties to an appeal shall not be entitled to produce additional evidence in the Appellate Court unless the Court so orders.

An Appellate Court, on its own motion or in response to a motion by a party, may issue an order allowing the presentation of additional evidence, including the testimony of witnesses, if it finds that:

the lower court has refused to admit evidence which ought to have been admitted;

a document must be produced or a witness examined to enable the Court to pronounce judgment; or

for any other cause necessary to a just and fair disposition of the case.

Any decision made under sub-Article (2) shall state the reasons upon which it is based.
