Article 137
Testimonial Competence of Family Members
(1)
The prosecution may not call the parent, child or sibling of an accused person, including any half-siblings, to give a statement out of Court or to give evidence against an accused person in Court except where the Court is satisfied that proposed witness freely consented to give such a statement or to give such evidence.
#(2)
The preceding paragraph does not apply in any case where the parent or sibling of an accused person is allegedly a victim of the offence charged against that person.
#(3)
Nothing in this Article affects the competence of a parent or sibling of an accused person to give a statement or to give evidence in Court for the accused.
