Article 26
Resistible Coercion
(1)
Where the coercion was resistible and the person concerned was in a position to resist the coercion or avoid committing the act, he shall, as a general rule, be punishable.
#(2)
The Court may however, reduce the penalty unrestrictedly (Article 66) taking into consideration the circumstances of the case, in particular the degree and nature of the coercion, as well as personal circumstances and the relationship of strength, age or dependency existing between the person who was subjected to coercion and the person who exercised it.
