Article 1043
Power of the Court
(1)
In deciding on a dispute arising between two persons to whom water may be of use, the Court shall reconcile the conflicting interests with the respect due to holdership or ownership.
#(2)
Unless otherwise provided by law, any infringement of rights of holdership or ownership shall give rise to compensation.
