Alienation
(1)
To the extent that property subject to a usufruct is intended to be alienated, the usufructuary is entitled to alienate it in conformity with its destination.

In other cases a usufructuary may not alienate or encumber property without the consent of the owner or the authorization of the competent Court. Authorization is not granted, unless it is in the interest of the usufructuary or the owner and does not prejudice the interest of the other.
