Article 373

An application for leave to appeal out of time shall be in writing, and shall show good cause why the party did not appeal within the time set out in this Chapter.

The application shall be accompanied by such evidence as may be necessary to enable the court to decide whether the party was prevented for good cause from appealing in due time.

Prior to deciding on the application, the court shall hear both parties and may make with regard to evidence such orders as it thinks fit.
