Article 96

Where a charge is amended or replaced, the Court shall ask the prosecutor and the accused to state whether they are ready to proceed.

Where the prosecutor or the accused states that he is not ready, the Court shall order the matter adjourned to a fixed date so as to allow sufficient time to ensure that the parties are not prejudiced in the preparation of the case for trial upon the amended or replaced charge.
