Article 1538
Performance of a Contractual Obligation
A right of action to claim the performance of a contractual obligation to give or to do is prescribed by five years from the beginning of the day following the one on which the claim has become exigible.
#For an obligation to perform at an indeterminate time, the period referred to in sub-Article (1) does not begin to run until the day following the one by which the creditor has given notice of his intention to claim performance; and, in any case the right of action referred to in sub-Article (1) is prescribed by twenty years from the beginning of the day following the one on which the claim would have become exigible at its earliest, if need be after notification to that effect by the creditor.
