Article 65
Fines, Imprisonment and Capital Punishment
Capital punishment, imprisonment and fines may or shall be imposed as follows:
#Upon conviction of a Class 1 Serious Offence, the Court shall sentence the defendant to life imprisonment, or, where specifically authorized by law, to death, or to a definite term of imprisonment of not less than 23 years and not more than 27 years.
#Upon conviction of a Class 2 Serious Offence, the Court shall sentence the defendant to life imprisonment, or, where specifically authorized by law, to death, or to a definite term of imprisonment of not less than 19 years and not more than 23 years.
#Upon conviction of a Class 3 Serious Offence, the Court may sentence the defendant to a definite term of imprisonment of not less than 16 years and not more than 19 years.
#Upon conviction of a Class 4 serious offence, the Court may sentence the defendant to a definite term of imprisonment of not less than 13 years and not more than 16 years.
#Upon conviction of a Class 5 Serious Offence, the Court may sentence the defendant to a definite term of imprisonment of not less than 10 years and not more than 13 years.
#Upon conviction of a Class 6 Serious Offence the Court may sentence the defendant to a definite term of imprisonment of not less than 7 years and not more than 10 years
#Upon conviction of a Class 7 Serious Offence, the Court may sentence the defendant to a definite term of imprisonment of not less than 5 years and not more than 7 years.
#Upon conviction of a Class 8 Serious Offence, the Court may sentence the defendant to a definite term of imprisonment of not less than 3 years and not more than 5 years.
#Upon conviction of a Class 9 Serious Offence, the Court may sentence the defendant to a definite term of imprisonment of not less than 1 year and not more than 3 years.
#Upon conviction of a Class 1 Petty Offence, the Court may sentence the defendant to a definite term of imprisonment of not less than 6 months and not more than 12 months or may impose a fine of 20,001 – 50,000 Nakfas, to be set in intervals of 2,500 Nakfas.
#Upon conviction of a Class 2 Petty Offence, the Court may sentence the defendant to a definite term of imprisonment of not less than 1 month and not more than 6 months or may impose a fine of 5,001 – 20,000 Nakfas, to be set in intervals of 1,000 Nakfas.
#Upon conviction of a Class 3 Petty Offence, the Court may sentence the defendant to a definite term of imprisonment of not more than 1 month or may impose a fine of 500 - 5,000 Nakfas, to be set in intervals of 100 Nakfas.
