Article 1122

Where, at the time of registration of the agreement of division, all registered property involved in the division is encumbered with a hypothec or attached, this hypothec or attachment will, as of that time, attach itself to each apartment right for the entire debt.

Where, at the time of registration of the agreement of division, only part of the registered property is encumbered with a hypothec or attached, the power to execute against this part continues to exist in spite of the division; execution terminates the division in respect of that part.

A servitude or usufruct encumbering the registered property, or part of it, at the time of the registration of the agreement of division, continues to, exist without change after that time.
