Article 1149
Authorization by Court
If one or more persons mentioned in the first sub-Article of the preceding article remain silent or refuse to cooperate or consent without reasonable ground, this cooperation or permission may be replaced by an authorization of the competent Court in whose jurisdiction the building, or the larger part of it, is situated.
#The authorization may only be granted upon the request of one or more apartment owners holding at least one half of the number of votes in the meeting of owners.
#The authorization may also be granted upon the request of '. two apartment owners, or of one apartment owner with several apartment rights, where the modification is exclusively intended to change the mutual boundary of the portions which are intended to be used by them as separate: units, whether or not accompanied by a change in the mutual relationship between their shares in the property: involved in the division, or their contributions to the debts and expenses which the apartment owners bear by virtue of the law or the by-laws.
#All persons whose cooperation or permission is required pursuant to the foregoing article, are individually summoned to be heard upon a request as referred to in the preceding sub-Articles.
