Article 1123
Transfer
(1)
An apartment right can be transferred, attributed in a partition, encumbered and executed against as independent registered property.
#(2)
Without prejudice to the provisions of the foregoing, property involved in the division cannot be wholly or partially transferred, attributed, encumbered or executed.
#(3)
Termination of the division in respect of a part of the registered property involved in the division cannot take place except by modification of the agreement of division.
#(4)
Contrary to sub-Article (2), the apartment owners can encumber immovable properties involved in the division with a servitude.
