Article 1153
Order by Court
Upon the request of a person whose cooperation is required for the modification of the deed of division or for the determination of the division the competent Court in whose jurisdiction the building, or the larger part of it, is situated may order that the agreement of division be modified or that the division be terminated:
#where the lay-out of the portions of the building which are intended to be used as separate units does not show this destination;
#where the construction or lay-out of the building or the lay-out of the land belonging to it does not conform or no longer conforms to the description in.: the agreement of division;
#in the event of division of a right in a building which is intended to be constructed or the lay-out of which is intended to be changed, where the construction or the modified lay-out of the building has not been completed within a period of three years from the day of registration;
#where part of the registered property involved in the division has been executed against; where part of the cadastral lots has been expropriated; or where the person who has made the division did not have the right to dispose of part of the registered property involved in the division;
#where the building has been seriously damaged or wholly or partially demolished, unless it is to be expected that repairs will be made within a reasonable period; or
#All persons whose cooperation or permission is required, are individually summoned to be heard upon a request as referred to in the preceding sub-Articles.
