Article 1749
Making the Seller Join as Party to Proceedings
(1)
Where the buyer is sued for breach of warranties by a third party as set out in Article 1745 and 1746, the buyer shall make the seller join him as a party to the proceedings instituted against him.
#(2)
Where the seller is joined in the proceedings in due time, he shall make good his warranty unless he can show that dispossession is due to the act of the buyer.
#(3)
Where the seller is not joined in the proceedings without any fault on his part, he shall be released from his warranty where he can show that the proceedings might have had a more favorable issue, had he been joined in due time.
