Article 2374
Definition
(1)
Mandate is a contract whereby one party, the mandatary, binds himself toward the other party, the mandator, to perform one or more juridical acts on account of the mandator without there being a relationship of employment.

The contract may oblige the mandatary to act in his own name; it may also oblige him to act in the name of the mandator.
