Article 2391
Liability of the Mandatary
(1)
A mandatary who acts w thout power or who acts outside the scope of his power, filing ratification, is liable to pay the third party such con pensation as will place the third party in the same position as he would have been in if the mandatary had acted with power and within the scope of his power.

The mandatary shallot be liable, however, if the Nhip party knew or ought to have known that the mandate had no power or vis acting outside the scope of is 46 power, or if the mandatary had fully communicated the content of the mandate to the other party.
