Article 2392
Proof of Mandate
(1)
A party may refuse to accept a declaration made by a mandatary, if he has forthwith asked the mandatary for proof of the mandate and he does not receive without delay proof in writing of the mandate nor confirmation thereof by the mandator.

Proof of mandate cannot be required if the mandator has informed the other party of the mandate, if it has been made public in a manner determined by law or usage, or if it results from an appointment known to the other party.
