Article 2413
Remuneration of Commission Merchant
(1)
Where the remuneration of the commission merchant has not been agreed upon between the parties, it shall be fixed in accordance with the custom of the place where the contract was entered into by the commission merchant.
#(2)
Failing such custom, the Court shall fix it on the basis of equity having regard to the work performed by the commission merchant, the expenses he incurred and the risks he assumed.
#(3)
Where he acted as del credere commission merchant, the commission merchant shall be entitled to a special remuneration to be fixed under the terms of the contract or in accordance with usage or equity.
