Article 2670
Rights of Secured Creditors
(1)
Notwithstanding any provision to the contrary, if pledged or hypothecated property is insured, the insurer shall pay compensation to the pledgee or hypothecary creditor.
#(2)
The pledgee or hypothecary creditor may claim directly from the insurer who may set up the defenses which he could have set up against the insured.
#(3)
Payments made in good faith by the insurer to the insured in ignorance of the pledge or hypothec shall extinguish the insurer’s obligation.
