Article 2590
Voluntary Performance of Obligation
(1)
He who acquires a hypothecated immovable may pay a creditor having a registered claim on such immovable: with the consent of such creditor or, where the immovable is attached on the latter’s request, without such consent.

In such case, he shall be subrogated to the rights of such creditor and merger may not be raised against him.
