Article 2043
Restoration: Amount of Damages
(1)
Where the things which are not restored have been valued conjointly by the parties, the lessee shall be bound by the amount of such valuation.
#(2)
The lessor may obtain additional damages where he proves that the lessee has alienated such things at a price higher than the amount of the valuation.
#(3)
The provisions of sub-Article (2) shall not apply where the alienation of the thing by the lessee amounted to an act of management according to the common intention of the lessor and lessee at the time of the conclusion of the contract of lease.
