Article 789

The testator may order that his heir or legatee shall, on the expiry of a certain period or on his death or on the accomplishment of a specified condition, pass the property or certain property forming part of the succession to one or more other persons who shall be substituted for him.

The heir or the legatee who receives the property in the first place is called the “institute”.

The person to whom he shall pass the property on the opening of the substitution is the “substitute”.
