Article 798
Special Provision Regarding Descendants
(1)
An express disinheritance of a child or other descendant shall be of no effect unless the testator has given in his will a reason which justifies the disinheritance.
#(2)
Where the will of the testator results in a descendant receiving less than half of what such descendant would have received in intestate succession, the provision of sub Article (1) shall apply by analogy.
#(3)
The Court shall ascertain whether the reason given by the testator, assuming that it is correct, justifies the disinheritance.
#(4)
It may not ascertain whether in the circumstances of the particular case, the reason given is correct.
