Article 190
Divorce of Parents
(1)
In case of divorce of the father and mother, they shall remain joint guardians of their minor child, unless the family arbitrators or the Court decide in the interest of the minor that the father or the mother alone shall be guardian.
#(2)
The surviving father or mother who is not guardian, shall as of right acquire the exercise of such function where his or her divorced spouse who is guardian, dies, unless the family council or the Court decide in the interest of the minor that the mother or father shall not be guardian. Article 195 is applicable mutatis mutandis.
