Article 2256

Unless otherwise expressly agreed, advance notice of termination shall be given as follows:

seven days before termination where the employee has been employed for less than one year;

fourteen days before termination where the employee has been employed for more than one year and less than two years;

twenty-one days before termination where the employee has been employed for more than two years and less than five years; and

thirty days before termination where the employee has been employed for more than five years.

An employer may, in lieu of notice, pay the employee a sum equal to the wages the employee would earn during the period of notice.
