Article 1652
Insured Victim
(1)
Where the victim is insured, he may claim compensation for the injury inflicted on him on the same terms as though he had not been insured.
#(2)
The insurer has no independent claim to be indemnified by the person liable for the fact which has caused the risk covered by the insurance contract to materialize.
#(3)
The insurance contract may, however, provide for the subrogation of the insurer to the victim's claim against the person liable.
