Article 1698
Shared fault
(1)
Where several persons have contributed by their fault to cause the same injury, the Court fixes equitably the proportion of the obligation ultimately to be borne by each of these persons.
#(2)
In making its decision, the Court shall have regard to all the circumstances, in particular the extent to which the respective faults have contributed to cause the injury and the gravity of each fault.
