Article 1653
Victim Pensioned Off
(1)
Where the victim receives a pension as a result of the fact which caused him injury, he may claim compensation for the injury inflicted on him on the same terms as though: he were not receiving a pension.
#(2)
The person paying the pension has no independent claim to be indemnified by the person liable for the fact which has caused the pension to fall due.
#(3)
The legal bond joining him to the victim may, however, provide for his subrogation to the victim’s claim against the person liable.
